Terms of Use

1. Use of the Services

Eligibility: You must be at least 13 years old to use the Services.

License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal purposes and Studio to create lawful content for personal or commercial projects. This does not grant permission to resell, sublicense, copy, or commercially exploit the Services themselves.

Studio Accounts: You must provide accurate account information, keep your password and connected-device credentials secure, and notify us promptly if you believe your account has been compromised. You are responsible for activity performed through your Studio account.

Prohibited Conduct: You agree not to:

• Reverse engineer, decompile, or disassemble the Services except where applicable law permits it.
• Use the Services for any illegal or unauthorized purpose.
• Attempt to gain unauthorized access to Studio accounts, devices, systems, or data.
• Upload malicious code or use the Services in a way that materially disrupts other users.
• Harass, abuse, or harm another person via the Services.

2. Health and Fitness Disclaimer

The App provides features that track workouts and health metrics (e.g., heart rate, calories).

Not Medical Advice: The App is for informational purposes only and is not intended to diagnose, treat, cure, or prevent any disease. Always consult a physician before starting a new fitness program, especially if you have pre-existing health conditions.

Accuracy: While we strive for accuracy, the data provided by the App (e.g., calorie count) is an estimate and should not be relied upon for medical purposes.

3. Subscriptions and Purchases

The App offers a "Padel Pointer Pro" subscription that unlocks additional features.

• Billing: Payment will be charged to your Apple ID account at confirmation of purchase.
• Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Cancellation: You can manage and cancel your subscriptions in your App Store Account Settings. We cannot cancel subscriptions on your behalf.
• Refunds: All purchases are processed by Apple. We do not issue refunds directly. Please contact Apple Support for refund requests.
• Price Changes: We reserve the right to change subscription prices. Any price changes will be communicated to you in advance by Apple.

4. User Content and Data

• Ownership: You retain ownership of the data you enter into the App (e.g., match scores).
• Studio Content: You retain ownership of match data, template choices, and other content you submit to Studio. You give us a limited licence to host, process, reproduce, and transform that content only as needed to operate Studio, generate requested outputs, maintain security, and provide support.
• Your Responsibilities: You must have the right to use content you submit, including match information and any personal information about other players. Do not upload unlawful, infringing, or unnecessarily sensitive information.
• Storage and Backups: App data is stored on your device and may sync through your personal iCloud account. Data you deliberately import into Studio is stored on Studio infrastructure. We recommend keeping appropriate copies of important source data and exported files.

5. Intellectual Property

The Services, including their design, text, graphics, and code, are the property of Alex Dernie and is protected by copyright, trademark, and other intellectual property laws. "Padel Pointer" is a trademark of Alex Dernie.

6. Limitation of Liability

To the fullest extent permitted by law:

• The Services are provided "as is" and "as available" without warranties of any kind, either express or implied.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Services.
• Our total liability for any claim arising out of these Terms or the Services shall not exceed the amount you paid us in the last twelve (12) months.

Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, or for fraud or fraudulent misrepresentation.

7. Third-Party Services

The Services may use third-party providers including RevenueCat, PostHog, OneSignal, Neon, Google Cloud, and Apple services such as iCloud and Apple Push Notification service. Their processing is described in our Privacy Policy and may also be subject to their respective terms and privacy policies.

8. Termination

We may suspend or terminate access to Studio when reasonably necessary to protect the Services, other users, or comply with law, including where you materially breach these Terms. You may stop using the Services at any time and can permanently delete your Studio account through Studio account settings.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts of England and Wales.
